This DMCA Policy covers allegations of copyright infringement relating to material that may appear on the website located at and all subdomains thereto (the "Site").

Brookstone respects the intellectual property rights of others and has a policy of responding to notices of alleged copyright infringement that are in compliance with the Digital Millennium Copyright Act (DMCA).  The DMCA sets out certain requirements of how third parties can notify Brookstone of alleged copyright infringement and this policy describes those requirements so Brookstone can quickly evaluate your notification and take action if necessary.  Nothing in this policy constitutes legal advice to you by Brookstone and we encourage you to seek legal counsel.

Since Brookstone complies with the requirements of the DMCA, we will evaluate your notice of alleged infringement and, at our discretion and if warranted, will disable access to or remove the material described by your notice from the Site and/or terminate or disable the user account(s) responsible for submitting that material to the Site.

If someone alleges that material submitted by you to the Site infringes their copyright rights, and we remove that material, we will make a good faith effort to contact you so you can submit a counter notification.

If we remove or disable subscriber access in response to such a notice, we will make a good-faith attempt to contact the owner of the affected site, or the uploader of the affected material or post, so that they may make a counter notification. We may also document notices of alleged infringement on which we act. Your complaint will also be a matter of record. A copy of the legal notice may be sent to one or more third parties who may then make it available to the public.

To comply with the requirements of the DMCA, your notice to Brookstone's Copyright Agent must include substantially the following:

(i) Your physical or electronic signature or that of a person authorized to act on your behalf;

(ii) Identification of the copyrighted work(s) claimed to have been infringed;

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Site, such as URLS where the material is located;

(iv) Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address;

(v) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, your agent, or the law; and

(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
